Special Prosecutor drops probe into alleged attempted bribery of NPP MPs by unnamed businessman

Special Prosecutor Kissi Agyebeng has disclosed that his office is unable to pursue an investigation into the alleged bribery case involving a businessman attempting to influence the NPP Majority MPs against impeaching Finance Minister Ken Ofori-Atta.

In a report released on December 28, 2023, Agyebeng highlighted challenges stemming from the responses of Asante Akim MP Andy Appiah-Kubi, the accuser, and the unnamed businessman.

The report indicated that their statements appeared ‘rehearsed and well-choreographed,” creating a joint denial of the events described by Appiah-Kubi.

He explained that the circumstances of the case are such that the cooperation and testimony of the accuser of the well-known wealthy businessman are essential to a successful prosecution.

Therefore, in the context of the case, the gathered intelligence and investigation alone are insufficient to sustain criminal charges.

“The institution of criminal proceedings would of necessity require the input and testimony of the accuser. The events must be recounted by the attendees of the meeting if criminal charges are to be sustained. This is even more so as, naturally, it appears there is no record of the meeting,” he stated.

Highlighting the critical role of the accuser and the lack of cooperation from MPs, Agyebeng stated, “The investigation may be re-opened should the circumstances and further facts so dictate.”
