An Accra District Court has issued a bench warrant for the arrest of the Director of Sapalon Ghana Limited, a vehicle parts sales services at Airport Hills in Accra.
The Director, Abu Hassan, is said to have failed to pay social security contributions on behalf of his employees at the end of every month and failed to pay penalty as required by National Pensions Act of 2008 Act 766 and as amended by Section 7 of the National Pensions (Amendment) ACT 2014 (ACT 883).
He is said to have refused to do so for the period November 2018 to April 2019 which revealed accumulated arrears of GH¢4,164.48 and penalty of GH¢7,459.55 bringing the total to GH¢11,534.03.
According to the facts as presented to the court by the prosecutor, Louisa Boadu, Abu Hassan was notified of his obligations to the Trust and to arrange to pay the outstanding arrears through the service of demand notice in May 2018.
However, the notice expired in June 2019 without the accused person paying his debt to SSNIT.
He was therefore served with criminal summons to appear before the Court to answer on the charges but has consistently failed to do so.
The Court therefore issued a bench warrant for his arrest.
In a related development, a bench warrant has also been issued for the arrest of the Director of RH Express Couriers located in East Legon, Tay David.
According to the prosecution, a routine inspection conducted by compliance officers of the Trust into the books of the accused persons revealed that between May and July 2019, he failed to pay to the Trust, social security contributions in the sum of GH¢43,846.40.
This constitutes an offence under section 83(1) (d) (h) of the National Pensions Act, 2008 (Act 766) as amended by section 7 of the National Pensions (Amendment) Act, 2014 (Act 883).
This unpaid amount accumulated penalty of GH¢8,738.69 bringing the total indebtedness of the accused in social security contributions and penalty to GH¢52,588.09.
Efforts to get the accused to comply were to no avail and consequently criminal summons was served on him to appear in court.
The accused has, however, refused to attend to the court leading to the issuing of a bench warrant for his arrest.
